- General information
The terms and conditions set out below govern the content and permitted use of the website www.makeamove.cat (“the website”), which the Assemblea Nacional Catalana (“ANC”) – with registered office at carrer de la Marina, 315, 08025 Barcelona and tax registration number G65581621, registered in the Register of Associations and Federations of Catalonia, under registration number 46548-J/1 in accordance with Law 34/2002 of 11 July 2002 on information society services and electronic commerce – places at the disposal of persons interested in the Make a Move campaign and of internet users in general.
The website has been created and designed with the objective of making known all information and news relating to the Make a Move international campaign.
- General conditions
The objective of these general conditions is to govern access to and use of the website which the ANC places at the disposal of internet users free of charge, except for the cost of connection via the telecommunications network supplied by the access provider contracted by the users.
Access to and navigation on the website imply unreserved acceptance of all the conditions set out in this document.
- Conditions of use
Internet users shall be under an obligation to make proper use of the website, in accordance with the Spanish and European legislation in force and with the conditions set out in this document. Internet users shall be liable to the ANC or other third parties for any damage and/or prejudice which might arise as a consequence of failure to comply with these obligations.
Use of the website for purposes harmful to the assets or interests of the ANC or of other third parties or which in any other way overload, damage or render unusable the networks, servers and other computer equipment (hardware) or products and applications (software) of the ANC or other third parties is strictly prohibited.
The ANC reserves the right, at any time and without prior notice, to alter and update the information contained on the website, its configuration and presentation or conditions of use.
The duration of the service provided by the website shall be limited to the time that the internet users are connected to the network or to one of the services facilitated via it. For this reason, internet users are recommended to read these terms and conditions with due attention every time they intend to enter and use the website, as the terms and conditions might have been amended.
The ANC gives no guarantee of lack of interruptions of or of errors in access to the website or its content, nor that the content will always be up to date. Provided no causes are involved which make this impossible or difficult to do, as soon as the ANC receives notice of any errors, disconnections or content which is out of date the ANC will do everything necessary to resolve the errors, re-establish the communication and update the content.
Both access to the website and any unauthorized use made of the information which it contains shall be the sole responsibility of the person carrying them out.
The ANC shall not be liable for any outcomes, damage or prejudice which might arise from such access or use. The ANC denies all liability for any security errors which may arise or for any possible damage to the computer system (hardware and software) of the internet users or to the files or documents stored therein, due to: a virus in the computer which the internet user used to connect to the content of the website, a malfunction of the browser or use of outdated versions of the browser.
The ANC accepts no liability with respect to the content of links to the website, insofar as they are to outside sources, and gives no guarantee that they will be free of viruses or other features which could alter the computer system (hardware and software), documents or files of internet users and denies all liability for damages of any kind caused for this reason.
Internet users who consider that the content of or services provided by the pages linked to the website are unlawful or damage the assets or rights of the users themselves or of a third party entitled to compensation, in particular in the form of activities or content which:
- are likely to be considered offences under criminal law,
- breach intellectual or industrial property rights,
- endanger public order, criminal investigations or public security,
- endanger protection of public health, respect for the dignity of persons or the principle of non-discrimination and protection of health and infants, shall notify it, accompanied by their observations or any unlawful acts observed.
- Procedure in the event of unlawful activities
Internet users who find facts or circumstances suggesting the unlawful nature of use of any content and/or of any activity on the website, in
particular any breach of intellectual or industrial property rights (patents, models and industrial drawings, trademarks and commercial names, etc.) or other rights shall send a notification to the ANC containing:
- details of the person or entity making the claim: name, address, telephone number and email address,
- a description of the allegedly unlawful activity on the website – in particular when it consists of an alleged breach of rights – giving a precise indication of the specific content protected and of its location on the website,
- the facts or circumstances that suggest the unlawful nature of the activity,
- in the event of a breach of rights, a signature by hand or equivalent, with particulars of the holder of the rights allegedly breached or of the person authorized to act on behalf of the holder,
- an express, clear declaration, on the responsibility of the person or entity making the claim, that the information provided in the notification is true and of the unlawful nature of the use of the content or of the activities described.

- Data provided by internet users
Generally, access to the website requires no prior subscription or registration on the part of internet users.
All the information provided by internet users on the forms on the website must be true. Internet users must guarantee the authenticity of all the data supplied to the ANC by this means. Likewise, internet users shall be responsible for keeping all the information supplied to the ANC permanently up to date, so that it corresponds to their real situation at all times. In any event, internet users will bear sole liability for any false or inaccurate information they supply and for any prejudices caused to the ANC or third parties by the information supplied.
Provision of a link to the website implies the existence of past or present relations between the ANC and the owner of the website on which it is provided and in no way implies either acceptance or approval by the ANC of its content or services.
Any other use of the content of the website for the benefit of unauthorized third parties is expressly prohibited.
The ANC accepts no responsibility for the information contained on the websites of third parties which can be accessed via links or browsers from the website.
- Intellectual and industrial property
The intellectual property rights over the website are owned by the ANC, which holds exclusive rights of use, including reproduction, distribution, public communication and modification. By way of examples, these rights shall include the software, source code, graphic design, navigation structure, databases, texts, photographs and images and, in general, all the content and features contained therein. Likewise, the trademarks, commercial names or distinctive signs are owned exclusively by the ANC or, where appropriate, by other third parties, unless stated otherwise.
The ANC owns the intellectual property rights relating to its products and services, in respect to citations by third parties.
All transfers of the intellectual property rights over the website are expressly prohibited. Specifically, reproduction, modification, distribution, public communication, provision, extraction, re-use or use of any kind, by any means or procedure, of any content is prohibited, except in cases permitted by law, that is authorized by the holder of the corresponding rights.
Unauthorized use of the information contained on the website, resale thereof or transfer of the intellectual property rights of the ANC shall give rise to the liabilities established by law.
Internet users shall respect all the intellectual and industrial property rights over the website. This notwithstanding, internet users may view and obtain a temporary private copy of the content for their exclusive personal and private use in their computer systems (software and hardware), provided it is not for the purposes of activities of a commercial or professional nature, nor of distribution, modification, alteration or decompilation. Breach of any of the abovementioned rights could constitute an infringement of these terms and conditions and an offence under the Criminal Code.

Any controversy or issue relating to this website or the activities carried out on it shall be settled in accordance with the Spanish and European legislation in force to which the ANC and internet users shall be expressly subject, expressly renouncing all other forums. Any dispute deriving from or relating to use of the website shall be settled by the courts and tribunals of Barcelona.
